3. Applicable Law and Transition

The DPDP Act, 2023 and the DPDP Rules, 2025 have been notified with staggered commencement dates.

Until the provisions of the DPDP Act and DPDP Rules applicable to our processing come into force, our processing of personal data will continue to be governed by applicable law then in force, including, where applicable, the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

Where withdrawal prevents us from performing an already confirmed booking, cancellation, Supplier charges, non-refundable amounts and other applicable booking terms may continue to apply.

10.1 Independent Suppliers and Third Parties

Depending on the nature of the transaction, a Supplier or other third party may process personal data as our Data Processor, as an independent Data Fiduciary, or in another capacity recognised under applicable law.

Where an independent Supplier processes personal data for its own purposes, that Supplier's own privacy policy, terms and applicable law will govern its independent processing.

We do not control the independent processing, retention, security practices or privacy policies of independent Suppliers and third parties and, except to the extent liability is imposed on us by applicable law, we shall not be responsible for their independent acts or omissions.

10.2 Data Processors

Where we engage a Data Processor, we may require the processor, as appropriate to the nature of the engagement and applicable law, to process personal data only for authorised purposes and to maintain appropriate confidentiality and security safeguards.

We may retain transaction references, payment status, billing information and other information reasonably necessary for accounting, reconciliation, refund processing, fraud prevention, taxation and legal compliance.

Our website may use cookies and similar technologies.

Strictly necessary cookies may be used to operate the website, maintain sessions, remember necessary technical information and protect the security of our website and services.

Preference, analytics and advertising cookies will be used in accordance with applicable law and, where consent is legally required, only after the relevant consent mechanism has been presented and consent has been obtained.

You may be able to manage or delete cookies through your browser settings and, where available, through our website's cookie settings.

Disabling strictly necessary cookies may prevent certain portions of the website from functioning properly.

Where we use non-essential cookies or similar technologies, details regarding their purposes, duration and relevant third parties may be provided through our Cookie Policy and/or cookie-consent mechanism.

We may provide users with mechanisms to manage applicable advertising or analytics preferences through our website or relevant third-party platforms.

We do not knowingly direct behavioural advertising at children where prohibited by applicable law.

16. Marketing Communications

Where you have provided the required consent or where otherwise permitted by applicable law, Trail With Ease may contact you through email, WhatsApp, SMS, telephone or other electronic channels regarding travel packages, offers, destinations, discounts and other Services.

Promotional communications will be sent subject to applicable telecommunications, anti-spam, consent and customer-preference requirements.

You may opt out of promotional communications at any time through the unsubscribe mechanism provided in the relevant communication or by contacting us using the details in this Policy.

Opting out of promotional communications does not prevent us from sending communications reasonably necessary for a live booking, enquiry or transaction, including booking confirmations, invoices, payment information, cancellation information, itinerary changes, visa requirements, travel documentation requirements, emergency notices, security notices and other service-related communications.

17. Fraud, Security and Misuse

We may process personal data to detect, investigate and prevent:

Security measures may be modified, enhanced or replaced from time to time depending upon technological developments, operational requirements and the nature of the risks involved.

No method of electronic transmission or storage can be guaranteed to be completely secure. Accordingly, while we take reasonable steps to protect personal data, we do not warrant that any electronic transmission, website, communication channel or storage system will be completely secure or free from every possible security threat.

You must keep your account credentials, passwords, OTPs and payment information confidential and should immediately notify us if you become aware of unauthorised use.

We will not be responsible, to the extent permitted by law, for losses arising directly from your voluntary disclosure of passwords, OTPs, payment credentials or other authentication information to another person, or from your failure to take reasonable steps to protect such information.

19. Personal Data Breaches and Security Incidents

We maintain procedures for identifying, assessing and responding to suspected security incidents involving personal data.

Not every security event constitutes a legally reportable personal data breach. We will assess suspected incidents in accordance with applicable law and our internal incident-response procedures.

Where a personal data breach is required to be notified under applicable law, we will make the required notifications within the applicable time and in the manner prescribed by law.

Where legally required, notifications may describe the nature of the breach, the categories of information affected, relevant consequences, measures taken or proposed to mitigate the breach, and steps which affected persons may take.

20. Data Retention

Enquiry records which do not result in a booking may be retained for as long as reasonably necessary for customer-service, business, legal, compliance, fraud-prevention and record-keeping purposes and may thereafter be deleted, anonymised or otherwise disposed of in accordance with our retention practices and applicable law.

Where personal data is no longer required and there is no legal or other permitted reason for continued retention, we may delete, anonymise or otherwise dispose of it.

We may retain personal data beyond an otherwise applicable retention period where reasonably necessary to establish, exercise or defend a legal claim, respond to a complaint or investigation, prevent fraud or misuse, enforce our agreements, or comply with a legal or regulatory requirement.

21. Children's Personal Data

We do not permit persons below 18 years of age to create an account or independently make a booking where the applicable Service requires the customer to be an adult.

Where personal data relating to a child is required for a travel booking, flight, hotel booking, visa application or family travel, such information may be provided by the child's parent or lawful guardian or another person authorised to act on behalf of the child.

Where applicable law requires verifiable consent of a parent or lawful guardian for processing a child's personal data, we will obtain or verify such consent in the manner required by applicable law.

We will not knowingly undertake processing of a child's personal data in a manner prohibited by applicable law.

Where required by applicable law, we will not undertake tracking, behavioural monitoring or targeted advertising directed at children.

If you believe that personal data relating to a child has been provided to us without the necessary authority or consent, please contact us using the details provided below.

24. Travel Suppliers and Independent Service Providers

Trail With Ease does not own or control every airline, hotel, resort, transport provider, activity provider, visa service provider or other Supplier involved in a booking.

We may act as a booking facilitator, intermediary, coordinator or agent for Services provided by independent Suppliers.

The relevant Supplier may independently determine its own operational procedures, eligibility requirements, cancellation rules, refund rules, documentation requirements, privacy practices, security practices and retention periods.

Where a Supplier processes your personal data independently, its own privacy policy and terms will apply to that processing.

We are not responsible for an independent Supplier's acts, omissions, processing, retention, security practices, data breach or privacy practices except to the extent responsibility is imposed upon Trail With Ease by applicable law.

25. Third-Party Websites and Services

Our website, emails, WhatsApp communications, social-media pages and other communications may contain links or references to third-party websites or services, including airlines, hotels, payment providers, visa providers, social-media platforms and other travel partners.

Our Privacy Policy does not apply to those third-party websites or services.

We recommend that you review the relevant third party's privacy policy and terms before providing personal data directly to that third party.

To the fullest extent permitted by applicable law, Trail With Ease does not guarantee the privacy, security, availability, accuracy or content of third-party websites or services and is not responsible for their independent processing of your personal data.

26. International Transfers of Personal Data

Travel Services may require personal data to be shared with airlines, hotels, Suppliers, visa authorities, transport providers, destination management companies and other entities located outside India.

Where international travel or a foreign Supplier is involved, personal data may therefore be transferred outside India where reasonably necessary to provide or administer the requested Service.

Such transfers will be undertaken in accordance with applicable law and any restrictions, safeguards or requirements prescribed by the Central Government or other competent authority from time to time.

International Suppliers may independently process personal data in accordance with the laws applicable to them and their own privacy policies.

Where a foreign Supplier acts independently rather than as our Data Processor, Trail With Ease does not control that Supplier's independent processing, security arrangements or retention practices.

Where the applicable provisions relating to Consent Managers become applicable to our processing, we will support consent-management mechanisms required by applicable law to the extent applicable to us.

Where applicable, consent may be capable of being given, managed, reviewed or withdrawn through a registered Consent Manager or another mechanism recognised under law.

Where we use automated tools, algorithms or software to assist with destination, package, itinerary or pricing recommendations, such tools are intended to assist our customers and our personnel in the travel-planning process.

We do not intend for automated tools used by us to make decisions producing legal or similarly significant effects concerning you without appropriate human involvement where such involvement is required by applicable law.

The availability and functionality of automated recommendation tools may change as our technology and Services develop.
