These Terms and Conditions ("Terms") govern the use of travel-related services provided by TrailWithEase Private Limited, a company incorporated under the Companies Act, 2013 bearing CIN U79110RJ2026PTC112863 and having its registered office at TB-508,Capital Highstreet, Jaipur, Mrec Jaipur, Jaipur, Jaipur- 302017, Rajasthan, operating under the brand name Trail With Ease ("Company", "we", "us", "our"). These Terms constitute an electronic record within the meaning of the Information Technology Act, 2000 and are enforceable under Section 10A of that Act. They do not require any physical or digital signature.
By accessing or using the Website, submitting an enquiry, requesting a quotation, creating an account, making a payment, making a Booking, or availing any Service, and where applicable by affirmatively accepting these Terms through the Website or other booking channel, you acknowledge that you have read, understood and agreed to be bound by these Terms. If you do not accept these Terms, you must not use the Website or our Services.
These Terms apply to all bookings and services offered by Trail With Ease, including but not limited to holiday packages, flight bookings, hotel reservations, visa assistance, transfers, sightseeing, activities, referral of travel insurance, and other allied travel services.
1. Definitions
Customer, You, Your shall mean any individual or entity accessing our website or availing our services.
Services shall mean all travel-related products and services offered by TrailWithEase, including domestic and international holiday packages, flights, hotel bookings, transportation, visa assistance, sightseeing, activities, and related travel services.
Supplier/Partner shall mean third-party service providers including airlines, hotels, resorts, transport operators, activity providers, visa processing agencies, insurance providers, and other vendors associated with service delivery.
Booking shall mean any reservation made through our website, sales team, or authorized representatives and confirmed by TrailWithEase.
Website shall mean the official website and digital platforms operated or authorized by TrailWithEase.
Confirmed Booking shall mean a Booking in respect of which the Company has issued a written booking confirmation bearing a booking reference number, following receipt of the payment required for confirmation.
Total Price shall mean the total amount payable by the Customer for a Booking, inclusive of all taxes, statutory levies, convenience fees, service fees, and other charges, as displayed to the Customer before payment is authorised.
Consumer shall have the meaning assigned to it under Section 2(7) of the Consumer Protection Act, 2019.
Grievance Officer shall mean the officer appointed by the Company under Rule 4(4) of the Consumer Protection (E-Commerce) Rules, 2020 and, where applicable, under Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, whose particulars are set out in Clause 30.
Force Majeure Event shall have the meaning set out in Clause 19.
1A. Our Role, Legal Status and Mandatory Disclosures
The Company is an e-commerce entity within the meaning of the Consumer Protection (E-Commerce) Rules, 2020. The particulars required to be disclosed under Rule 4(2) of those Rules are set out in Clause 30 and at the foot of these Terms.
The Company's role may vary depending upon the nature of the Service and the applicable contractual arrangement. The Company may act as principal, travel organiser, reseller, booking facilitator, intermediary, coordinator, agent or service provider. The applicable quotation, invoice, Booking confirmation, itinerary and service-specific terms shall identify, where reasonably practicable, the capacity in which the Company is acting.
In relation to holiday packages designed, priced, and sold by the Company under its own brand, the Company contracts with the Customer as principal and is responsible for procuring the services described in the confirmed itinerary.
In relation to flights, hotels, activities, transfers, visa lodgement, and similar services which the Customer selects and which the Company books with a third party on the Customer's instructions, the Company may acts as a disclosed agent, facilitator or intermediary of that Supplier, and the contract for the supply of those services may be between the Customer and the relevant Supplier, as applicable. The Company's obligation in that capacity is to exercise reasonable care and skill in making the booking and in transmitting the Customer's instructions. Section 230 of the Indian Contract Act, 1872 shall apply to the extent applicable and not inconsistent with the applicable law.
The Company shall state on the quotation, itinerary, or booking confirmation whether it acts as principal or as agent in respect of each component of a Booking. Where no such statement is made in respect of a component, the Company shall be treated as having contracted as principal for that component.
Nothing in this Clause limits any liability of the Company to a Consumer under the Consumer Protection Act, 2019.
1B. Order of Precedence and Service-Specific Terms
The Services may be subject to additional terms, conditions, policies, fare rules, cancellation rules, refund rules, documentation requirements and other conditions of the relevant Supplier or service provider. Such terms shall form part of the applicable Booking where expressly communicated to or incorporated into the quotation, Booking confirmation, itinerary or other Booking document. In the event of any inconsistency, the Booking-specific terms shall prevail in relation to the relevant Service component, followed by these Terms, subject always to applicable law.
2. Use of Services- Refusal/Cancellation
Customers must be at least 18 years of age and competent to contract under Section 11 of the Indian Contract Act, 1872 to make bookings through Trail With Ease. A Booking that includes a person below 18 years of age must be made by that person's parent or lawful guardian, who shall remain responsible for the minor throughout the journey and who consents to the processing of the minor's personal data in the manner set out in our Privacy Policy.
Customers agree to provide accurate and complete information at the time of booking, including traveller names, passport details, travel dates, contact details, and other required information.
Trail With Ease shall not be responsible for any loss, delay, cancellation, denial of service, or additional charges arising from incorrect or incomplete information provided by the Customer, save to the extent that such loss is caused by the Company's own error, negligence, or breach of these Terms.
Our services may only be used for lawful purposes. Fraudulent, unauthorized, or improper use of our website or services is strictly prohibited.
Trail With Ease reserves the right to refuse, suspend, modify or cancel any booking where it reasonably suspects fraud, misuse, impersonation, unauthorised activity, unlawful conduct, security concerns, payment irregularity, or violation of these Terms or applicable law. The Company may request additional information or verification before confirming or continuing a Booking. Where the Company takes such action, it may communicate the reasons to the Customer to the extent reasonably practicable and permitted by law. Where a Booking is refused or cancelled by the Company for any reason not attributable to the fraud, misconduct, payment failure, breach or other act or omission of the Customer, the Company shall refund the amount actually received by the Company in respect of the affected Booking, subject to any amount already irrevocably paid to a Supplier and not recoverable by the Company, where applicable.
2A. Account Registration and Security
Where the Website permits the Customer to create an account, the Customer is responsible for maintaining the confidentiality of the account credentials and for all activity carried out through the account, and must notify the Company immediately on becoming aware of any unauthorised use.
The Company may suspend or terminate an account on reasonable grounds, including suspected fraud or breach of these Terms, and shall communicate the reasons to the Customer. The Company does not permit persons below 18 years of age to register an account.
3. Pricing
All prices and quotations provided by Trail With Ease are indicative until a Booking is confirmed, and until such confirmation may change on account of fluctuations in airfare, hotel rates, currency exchange rates, taxes, supplier charges, availability, or other operational factors. Once a Booking is confirmed, the Total Price is subject to any change expressly permitted under the applicable Supplier terms, government taxes, statutory levies, foreign-exchange fluctuations, fuel or carrier-imposed surcharges, or other mandatory charges arising after confirmation. Any such increase shall, where reasonably practicable, be notified to the Customer with particulars of the applicable increase.
Unless specifically mentioned, prices may not include visa fees, travel insurance, meals, personal expenses, optional activities, entry fees, local taxes, or any additional services not expressly included in the booking. The quotation, itinerary, and booking confirmation shall set out in writing the inclusions and exclusions applicable to the Booking.
The Total Price payable, inclusive of all taxes, statutory levies, convenience fees, and service fees, shall be displayed to the Customer before payment is authorised, to the extent ascertainable at that stage, and any subsequently applicable mandatory government, statutory or Supplier charge may be payable by the Customer where permitted by law and the applicable booking terms. The final price shall be confirmed only after the Customer accepts the quotation, makes the required payment, and receives a booking confirmation from Trail With Ease.
3A. Fair Digital Practice
The Company does not employ any deceptive design practice identified in the Guidelines for Prevention and Regulation of Dark Patterns, 2023 issued by the Central Consumer Protection Authority, including drip pricing, basket sneaking, false urgency, forced action, confirm shaming, subscription traps, interface interference, bait and switch, disguised advertisements, nagging, and trick questions. Any statement of limited availability, countdown, discount, or saving displayed on the Website reflects the true position at the time of display and is capable of substantiation.
4. Payment
Payments must be made only through payment methods authorised by Trail With Ease, being the payment gateways displayed on the Website and the bank accounts held in the name of TrailWithEase Private Limited and notified in writing by the Company. The Company does not accept payment into the personal account of any employee, agent, or representative, and does not accept cash in excess of the limit prescribed under the Income-tax law.
Booking confirmation is subject to successful receipt of the required payment and confirmation/availability from the relevant Supplier, where applicable.
Where partial payment is accepted, the remaining balance must be paid within the specified timeline. Failure to make the balance payment within the required timeline may result in cancellation of the booking and applicable cancellation charges and/or forfeiture of amounts as specified in the applicable quotation, Supplier terms or Booking confirmation.
Where an amount is debited from the Customer's account but the Booking is not confirmed on account of a technical failure, the amount shall be processed in accordance with applicable RBI directions and the applicable payment service provider's procedures. Any compensation, where applicable, shall be governed by such directions.
5. Booking Confirmation
Once the required payment is received and the services are confirmed, TrailWithEase will issue a booking confirmation through email, WhatsApp, or another authorized communication channel.
Customers are responsible for reviewing all booking details, including traveller names, dates, flights, hotels, transfers, activities, inclusions, exclusions, and payment details.
Any discrepancy or apparent error must be reported to Trail With Ease as soon as practicable, and preferably within twenty-four hours of receiving the booking confirmation, so that the Company may seek a correction from the relevant Supplier. The Company shall use reasonable efforts to assist with corrections, but any correction shall remain subject to Supplier availability, applicable fare/rate rules and charges. This time limit does not apply to an error made by the Company itself, subject to the Company's right to correct such error in accordance with the applicable booking terms.
6. Cancellation, No-Show & Refunds
6.1 Cancellation
Cancellation of bookings is subject to the cancellation terms applicable to the respective service, package, supplier, and date of cancellation. The cancellation charges applicable to a Booking shall be disclosed to the Customer in writing before the Booking is confirmed and shall form part of the booking confirmation.
Different components of a package may have different cancellation policies. Flight tickets, hotels, activities, transfers, visa services, and other third-party services may have separate cancellation charges.
Certain services may be completely or partially non-refundable once booked or confirmed. Where a service is non-refundable, that fact shall be stated in the quotation and in the booking confirmation before payment is taken.
In case of cancellation of a package or combination booking, cancellation charges may be calculated separately for each service component.
In accordance with applicable law, the Company shall not impose any cancellation charge in circumstances where such charge is prohibited by law. Subject to applicable law, the Customer shall remain liable for the cancellation charges, Supplier charges, non-refundable amounts, taxes and fees applicable to the Booking and disclosed at the time of booking.
Where a Booking is cancelled by the Company or by a Supplier for reasons not attributable to the Customer, the Customer shall be entitled, subject to the applicable Supplier terms and amounts actually recoverable by the Company, to such refund or alternative arrangement as may be available.
6.2 Refund Process
Eligible refunds shall be processed as follows. Where the Company holds the amount to be refunded, the refund shall be initiated within a reasonable period and, where applicable, within the period prescribed by law or the relevant regulatory authority of the cancellation being confirmed. Where the refund relates to an air ticket, it shall be processed in accordance with the applicable DGCA requirements and the relevant airline/fare rules. Where the refund depends on an amount being received from a Supplier, the Company shall pursue the Supplier with reasonable diligence, keep the Customer informed where reasonably practicable, and remit the refund within a reasonable period after receipt and reconciliation of the refundable amount.
Refunds will be made to the original mode of payment where reasonably practicable after deducting the applicable cancellation charges, the service fee disclosed at the time of booking, and any supplier penalty actually levied. Other amounts may also be deducted where expressly permitted by the applicable Booking terms, law or Supplier conditions. The Company shall provide reasonable particulars of material deductions upon request.
Where the refund is dependent on an airline, hotel, embassy, insurance company, or other third-party supplier, the refund timeline and amount may vary.
In the case of an air ticket, all statutory taxes, User Development Fee, Airport Development Fee, and Passenger Service Fee shall be refunded to the extent required under applicable law and the applicable airline fare rules.
Where a flight booking is cancelled or amended within forty-eight hours of the booking being made, any applicable free-look/cancellation facility shall be governed by the prevailing DGCA requirements and the airline's applicable conditions.
Goods and Services Tax charged on a cancellation charge shall be dealt with in accordance with the prevailing law, and any tax actually refundable shall be passed on to the Customer.

6.3 No-Show
In the event of a no-show or failure to utilise a confirmed service without prior cancellation, no refund shall be applicable, except to the extent expressly provided under applicable law or the relevant Supplier's terms. In the case of an air ticket, statutory taxes and airport fees shall nonetheless be refunded to the extent required under applicable law and applicable airline rules.
Any rescheduling of a no-show booking shall be subject to availability and supplier policies and may attract additional charges.
7. Cancellation Procedure
All cancellation requests must be made in writing through Trail With Ease's official communication channels, and shall take effect from the date and time on which the request is received by the Company.
Upon receiving a cancellation request, TrailWithEase will use reasonable efforts to inform inform the Customer of the applicable cancellation charges based on the relevant supplier terms.
The Company shall acknowledge a cancellation request within a reasonable period and, where practicable, within forty-eight hours of receipt and shall communicate the applicable cancellation charges where such charges can reasonably be determined at that stage.
Cancellation shall be considered valid when the Company receives the cancellation request through an authorised channel, subject to any Supplier cut-off time and the Company's written confirmation of the applicable cancellation consequences.
Cancellation requests made verbally to hotels, drivers, guides, airlines, or other third parties shall not automatically constitute cancellation of the booking with TrailWithEase.
8. Booking Amendments
Requests to change travel dates, flights, hotels, room categories, transfers, activities, or other services are subject to availability and supplier policies.
Amendments may attract additional charges, fare differences, administrative fees, Company service charges or cancellation charges.
Certain bookings may not permit amendments after confirmation. The Company does not guarantee that an amendment can be accommodated and shall not be responsible for any loss or cost arising from the unavailability of an amendment requested by the Customer.
9. Itinerary Changes
Itineraries and services may change due to operational requirements, supplier constraints, weather conditions, airline schedule changes, local authority regulations, strikes, technical issues, or force majeure events, or in changes in availability, route or operating conditions, or other circumstances beyond the Company's reasonable control.
In such cases, TrailWithEase will make reasonable efforts to provide an alternative arrangement, where reasonably practicable and subject to availability, applicable Supplier terms and any additional cost.
Minor itinerary changes may be made where necessary for operational reasons and shall not automatically entitle the Customer to compensation. Where a material change is required, the company may, subject to the applicable Booking terms and supplier policies, offer any alternative arrangement or such refund as may be available.
10. Flights and Airline Services
Flight bookings are subject to the terms and conditions of the respective airline.
Flight schedules, routes, baggage allowances, seat availability, and other airline conditions may change without prior notice.
TrailWithEase shall not be responsible for delays, cancellations, denied boarding, schedule changes, baggage issues, strikes, technical problems, or other disruptions caused by the airline, except to the extent liability is imposed upon the Company by applicable law or arises from the Company's own act or omission.
Any refund or compensation relating to airline services shall be governed by the applicable Civil Aviation Requirements issued by the Directorate General of Civil Aviation, including those relating to denied boarding, cancellation, and delay, and by the Passenger Charter. The Company shall use reasonable efforts to assist the Customer in pursuing such a claim with the airline and shall pass on to the Customer any amount received from the airline on the Customer's behalf reconciliation and receipt.
A grievance relating to an airline may in addition be raised by the Customer on the AirSewa portal maintained by the Ministry of Civil Aviation.
11. Hotel and Accommodation Services
Hotel bookings are subject to the terms and conditions of the respective hotel or accommodation provider.
Room photographs, descriptions, facilities, amenities, and other information are based on information provided by the respective property and may vary.
Check-in and check-out times are determined by the respective hotel.
Early check-in, late check-out, room upgrades, connecting rooms, specific room locations, and special requests are subject to availability and are not guaranteed unless specifically confirmed.
Hotels may charge security deposits, local taxes, resort fees, city taxes, or other charges directly to the Customer. The Company shall disclose, to the extent such charges are known to it at the time of booking, every mandatory charge payable by the Customer directly at the property.
12. Visa Services
Visa approval or rejection is solely at the discretion of the respective embassy, consulate, immigration authority, or government agency.
TrailWithEase acts only as a facilitator for visa assistance and does not guarantee visa approval, processing time, visa issuance, admission, transit permission, or entry into any country.
Customers are responsible for providing genuine, accurate, complete, and valid documents within the timelines communicated by the Company or relevant authority.
Visa fees, embassy fees, service charges, courier charges, third-party charges, appointment fees and other related costs may be non-refundable in case of rejection, delay, withdrawal, or denial.
Where a visa application is not lodged on account of the Company's own default, the Company shall refund its own service charge to the extent attributable to the unperformed service.
TrailWithEase shall not be responsible for any loss arising from visa rejection, delayed processing, immigration refusal, incorrect documentation, failure to satisfy immigration requirements, transit-visa requirements, travel bans, or changes in visa requirements, except to the extent caused by the Company's own breach, negligence or wilful misconduct.
13. Travel Documents
It is the sole responsibility of the Customer to carry all valid travel documents required for their journey, including passports, visas, identity documents, travel insurance documents, vaccination certificates where applicable, and any other documents required by authorities or suppliers.
Customers must ensure that their passport meets the validity and other requirements of their destination.
Failure to carry valid documents may result in denied boarding, denied entry, cancellation, or denial of services without refund.
14. Travel Insurance
Customers are strongly advised to obtain appropriate travel insurance before travelling. The Company is not an insurer and does not provide, underwrite, or guarantee insurance coverage.
Travel insurance may provide coverage for medical emergencies, trip cancellations, baggage loss, travel delays, and other unforeseen circumstances, depending on the policy.
Customers are responsible for reviewing the coverage, exclusions, limits, and claim procedures of their insurance policy.
Trail With Ease is not registered with the Insurance Regulatory and Development Authority of India as an insurance agent, corporate agent, broker, or web aggregator, and does not solicit, procure, advise upon, or earn commission on any policy of insurance. Where the Customer wishes to purchase travel insurance, the Customer must contract directly with an insurer or with an intermediary registered with the said Authority, and Trail With Ease shall not be responsible for the terms of that policy or for any claim rejected by the insurance provider.
15. Third-Party Service Providers
TrailWithEase may use independent third-party service providers, including airlines, hotels, transport operators, activity providers, local tour operators, visa agencies, insurance providers, and other vendors.
Services provided by such suppliers are subject to their respective terms, conditions, policies, fare/rate rules, cancellation and refund conditions, eligibility requirements, operational limitations and other applicable conditions.
Where the Company acts as a disclosed agent, intermediary or facilitator, it shall not be responsible for delays, cancellations, service failures, negligence, acts, or omissions of independent third-party Suppliers, and the Customer's remedy in respect of those matters lies against the Supplier to the extent permitted by law. This Clause does not exclude the Company's own liability for failure to exercise reasonable care and skill in making the booking, nor any liability of the Company to a Consumer under the Consumer Protection Act, 2019, nor any liability which cannot lawfully be excluded.
16. Tour Documents and Customer Responsibility
Customers must carefully review all travel documents, vouchers, tickets, hotel confirmations, itineraries, and other documents provided by TrailWithEase.
Customers are responsible for following the instructions, timings, check-in requirements, baggage rules, safety instructions, and other applicable conditions communicated by the relevant service provider.
Failure to follow such requirements may result in additional charges, cancellation, denial of service, or loss of refund.
17. Health and Safety
Customers must comply with all applicable health, safety, local laws, customs, and regulations during their journey.
Customers are responsible for determining whether they are physically and otherwise fit to participate in any activity, excursion, or tour.
TrailWithEase does not provide medical, legal, immigration, or professional advice.
Customers should consult appropriate professionals where necessary before travelling or participating in specific activities.
18. Personal Belongings and Baggage
Customers are responsible for their personal belongings, valuables, baggage, travel documents, electronic devices, and other possessions during their journey.
TrailWithEase shall not be responsible for loss, theft, damage, or misplacement of personal belongings, except where liability is imposed under applicable law.
Baggage-related claims should be raised with the relevant airline, hotel, transport operator, or other service provider according to their applicable procedures.
19. Force Majeure
TrailWithEase shall not be responsible for delays, cancellations, changes, losses, or interruptions caused by circumstances beyond its reasonable control.
Such circumstances may include natural disasters, severe weather, pandemics, epidemics, war, terrorism, civil unrest, strikes, government restrictions, border closures, political disturbances, technical failures, airline disruptions, Supplier failures, transport disruptions, government or regulatory measures, visa or immigration restrictions, or other events beyond the Company's reasonable control.
In such circumstances, TrailWithEase will make reasonable efforts to assist Customers with available alternatives, but any alternative, refund, credit or other remedy shall remain subject to Supplier policies, availability, applicable law and amounts actually recoverable by the Company.
The Company shall not be obliged to provide any refund, compensation or alternative arrangement beyond the amounts or remedies actually available or recoverable from the relevant Supplier, except where otherwise required by applicable law or caused by the Company's own breach.
20. Website Usage and Copyright
All content available on the TrailWithEase website, including text, images, graphics, photographs, videos, logos, designs, trademarks, and other material, is owned by or licensed to TrailWithEase and is protected under applicable intellectual property laws.
Customers are prohibited from copying, reproducing, modifying, distributing, publishing, or commercially using any website content without prior written permission from TrailWithEase.
Unauthorized use of our content or intellectual property may result in legal action.
20A. Confidentiality and Customer Information
The Customer shall not misuse, disclose or commercially exploit any non-public information, documents, pricing, itineraries, proprietary material or confidential information provided by the Company in connection with the Services, except where disclosure is required by law or reasonably necessary for the Customer's travel arrangements. This Clause does not restrict the Company's collection, use, disclosure or processing of personal data in accordance with Clause 24 and the Privacy Policy.
20B. Customer Reviews, Photographs and User Content
Where the Customer voluntarily submits a review, rating, photograph, video, testimonial, comment, feedback or other content to the Company, the Customer represents that the Customer has the necessary rights and authority to submit such content. Subject to applicable law and the Privacy Policy, the Customer grants the Company a non-exclusive, worldwide, royalty-free licence to host, reproduce, publish, display, adapt and use such content for operating, improving and promoting the Company's Services. The Company may remove or decline to publish content which it reasonably considers unlawful, misleading, infringing, abusive, inappropriate or inconsistent with its policies.
20C. Electronic Records and Communications
The Customer agrees that quotations, Booking confirmations, invoices, itineraries, notices, cancellation confirmations, payment communications and other communications may be provided electronically through email, WhatsApp, SMS, the Website or other authorised electronic channels. Electronic records maintained by the Company may be relied upon as evidence of the relevant communication, transaction or Booking, subject to applicable law.
20D. Automated Recommendations and Personalisation
The Company may use automated tools, algorithms or software to assist with destination, package, itinerary, pricing or service recommendations. Such recommendations are intended to assist the Customer and do not constitute a guarantee of availability, suitability, price or outcome. The Company may modify or discontinue such tools as its Services and technology develop. Any processing of personal data in connection with such tools shall be governed by the Privacy Policy and applicable law.
20E. Corporate Transactions
The Company may assign, transfer or disclose information reasonably necessary in connection with any proposed or completed merger, acquisition, restructuring, financing, sale or transfer of assets, change of control, business reorganisation or similar corporate transaction, subject to applicable law and the Privacy Policy.
21. Third-Party Links
Our website or communications may contain links to third-party websites.
TrailWithEase does not control or endorse such websites and shall not be responsible for their content, security, availability, privacy practices, or policies.
Customers are advised to review the terms and privacy policies of third-party websites before using them.
22. Payment Gateway, Chargeback & Transaction Security
Payments made through our website may be processed through third-party payment gateways, payment aggregators, banks or other authorised payment service providers.
Trail With Ease does not store the complete card or banking details of Customers. Card details are stored, if at all, only in tokenised form by the payment aggregator or other authorised payment service provider in accordance with the directions of the Reserve Bank of India on card-on-file tokenisation. The Company shall not be responsible for technical errors, delays, interruptions, or failures caused by payment gateways, banks, or other third parties, except to the extent caused by the Company's own act or omission.
In case of a payment dispute or chargeback after a booking has been confirmed, TrailWithEase reserves the right to provide relevant booking, payment, communication, and service records to the concerned bank, payment gateway, card network, or financial institution for investigation, dispute resolution, fraud prevention or other lawful purposes.
Fraudulent or unauthorized transactions may result in cancellation or suspension of services without prior notice, subject to applicable law.
23. GST, TCS & Other Taxes
All applicable Goods and Services Tax, tax collected at source, government taxes, statutory charges, and other applicable levies shall be charged as per prevailing laws. Tax shall be collected at source on the sale of an overseas tour programme package at the rate prescribed from time to time under the Income-tax law, and the Company shall issue to the Customer the prescribed certificate of collection so that the Customer may claim credit for the amount collected.
Any change in applicable taxes or government charges notified after the date of booking may be additionally payable by the Customer, subject to the Company furnishing particulars of the change.
Customers are responsible for providing accurate billing details, including PAN, GSTIN, name, and address wherever applicable.
TrailWithEase shall not be responsible for tax-related consequences arising from incorrect information provided by the Customer.
24. Privacy and Customer Information
Trail With Ease is a collects, uses, stores, discloses and otherwise processes personal data in accordance with its Privacy Policy and applicable data-protection law.
Customer information may be shared with airlines, hotels, transport providers, visa processing agencies, insurance providers, payment processors, local operators, technology service providers, hosting providers, professional advisers, fraud-prevention providers, regulators, government authorities and other Suppliers or service providers where necessary or reasonably required to provide, administer, secure, improve or otherwise facilitate the Services, or where otherwise permitted or required by applicable law.
Trail With Ease will handle personal data in accordance with the Privacy Policy, the Digital Personal Data Protection Act, 2023, the Digital Personal Data Protection Rules, 2025, and other applicable data-protection and privacy laws, in each case to the extent applicable and from the date the relevant provisions become applicable to the Company. The Privacy Policy forms part of these Terms.
25. Communication Consent
By making an enquiry or booking with Trail With Ease, the Customer may receive communication through email, telephone, SMS, WhatsApp, or other electronic means regarding bookings, payments, travel updates, documentation, customer support, and other service-related information. Commercial communications shall be sent in accordance with applicable telecommunications, anti-spam, customer-preference and data-protection requirements and the Company's Privacy Policy.
The Customer may opt out of promotional communications at any time and without charge, by using the unsubscribe facility in the communication, by writing to the Company at the address in Clause 30, or through any other opt-out mechanism made available by the Company. Necessary booking and operational communications shall continue for so long as a Booking is live and may continue thereafter where reasonably necessary for refunds, complaints, disputes, accounting, legal compliance, fraud prevention or other legitimate business purposes. Consent to the processing of personal data may be withdrawn at any time in the manner set out in the Privacy Policy, subject to the Company's right to continue processing where permitted or required by applicable law and to the consequences set out in the Privacy Policy.
26. Phishing, Fraud & Fake Communications
Customers are advised to remain vigilant against fraudulent emails, messages, websites, social media accounts, payment requests, or individuals falsely claiming to represent TrailWithEase.
Customers should verify all payment requests and communications through official TrailWithEase channels.
TrailWithEase will not be responsible for losses resulting from payments made to unauthorized persons or through unofficial channels where the Company has not authorised the relevant payment channel and the loss does not arise from the Company's own breach, negligence or wilful misconduct.
Customers should never share passwords, OTPs, PINs, banking credentials, or other sensitive information with unknown individuals.
For any suspicious communication, Customers should contact TrailWithEase through its official contact details.
27. Customer Conduct
Customers are expected to behave responsibly and respectfully during their travel.
Customers must not engage in illegal activities, damage supplier property, threaten or abuse staff or service providers, provide false information, misuse travel documents, or engage in fraudulent activities.
Any additional costs, penalties, damages, or claims arising from the Customer's misconduct shall be payable by the Customer.
28. Disclaimer
Accuracy of information. The information provided on our website is for general informational purposes. While Trail With Ease makes reasonable efforts to ensure accuracy, we do not warrant that all information, pricing, availability, itineraries, or travel-related content will always be complete, accurate, or up to date. This Clause does not constitute a warranty or representation regarding any third-party Supplier or Service and does not affect the specific terms of a Confirmed Booking.
Changes to Services: Prices, itineraries, availability, schedules, and services may change due to supplier updates, operational requirements, weather, government regulations, currency fluctuations, or other external factors. The Company shall not be responsible for changes arising from such circumstances where the relevant matter is outside the Company's reasonable control.
Third-Party Services: TrailWithEase may facilitate services provided by independent third-party suppliers. The actual delivery of such services is subject to the terms and conditions of the respective suppliers.
Health and Safety: Customers are responsible for complying with all applicable health, safety, and local regulations during their journey.
Verification claims. Any statement on the Website that a property, stay, or experience has been verified, vetted, or inspected by the Company means only that the Company has carried out the checks described on the Website in relation to that property, stay, or experience. It is not a warranty as to the safety, condition, or suitability of the property, stay, or experience, for which the Supplier remains responsible. The Company shall not make any claim of verification, rating, or endorsement which it is unable to substantiate.
Travel advisories. Customers should consult the travel advisories issued by the Ministry of External Affairs, Government of India and by the competent authorities of the destination country before travelling, and should register on the MADAD portal where appropriate.
29. Limitation of Liability
Subject to Clause 29.3, the Company shall not be liable to the Customer for any indirect, incidental, special, or consequential loss, or for loss of profit or loss of business opportunity, loss of anticipated savings, loss of enjoyment, loss of goodwill, or other remote or non-direct loss.
Subject to Clause 29.3, the aggregate liability of the Company in respect of a Booking, whether in contract, in tort, under statute, or otherwise, shall not exceed the total amount actually received by the Company from the Customer in respect of that Booking or the value of the Service component giving rise to the claim, whichever is lower, to the extent permitted by applicable law.
Nothing in these Terms shall exclude or limit the Company's liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, for wilful misconduct, or for any other liability which cannot lawfully be excluded or limited, including any liability of the Company to a Consumer under the Consumer Protection Act, 2019 arising from a deficiency in service or an unfair trade practice.
29A. Indemnity
The Customer shall indemnify and keep indemnified the Company against any loss, claim, penalty, liability, cost and reasonable expense suffered by the Company arising from the Customer's provision of false, forged, or incomplete documents or information, from the Customer's breach of these Terms or of any law of India or of the destination country, from damage caused by the Customer to the property of a Supplier, from the customer's unlawful, fraudulent or negligent conduct and from any claim by a Supplier or an authority arising out of the Customer's conduct. The Company shall notify the Customer within a reasonable period where practicable of any such claim, shall not settle it in a manner that materially admits liability on behalf of the Customer without the Customer's written consent, where such consent is reasonably available, and shall take reasonable steps to mitigate the loss. This indemnity does not extend to any loss caused or contributed to by the Company's own act or omission.
30. Complaints and Customer Support
Customers should report any issue relating to a booked service to Trail With Ease as soon as reasonably possible so that reasonable efforts can be made to resolve the issue. The Company shall acknowledge every complaint within the period prescribed by applicable law and, where applicable, allot a unique ticket number to it, and communicate that ticket number to the Customer.
Complaints should be submitted through our official communication channels along with the relevant booking details and supporting documents. The Company shall redress the complaint within the period prescribed by applicable law and, where no specific statutory period applies, within a reasonable period having regard to the nature and complexity of the complaint.
Grievance Officer and Customer Support- Grievance Officer, appointed where required by applicable law.
Customer Support
A complaint relating to the Company's handling of personal data may be made to the Privacy & Data Protection Contact identified in the Privacy Policy.
If the Customer is not satisfied with the resolution offered, the Customer may approach the National Consumer Helpline on 1915 or through the INGRAM portal, or any other competent authority/forum available under applicable law, and, in the case of an aviation grievance, may use the AirSewa portal of the Ministry of Civil Aviation.
31. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
Any dispute arising out of or in connection with these Terms or the services provided by Trail With Ease shall be subject to the jurisdiction of the competent courts at Jaipur, Rajasthan, to the extent permitted by applicable law. Nothing in this Clause shall affect any mandatory statutory right or jurisdiction available to a Consumer or any other person under applicable law.
31A. Dispute Resolution for Non-Consumer Customers
Where the Customer is not a Consumer within the meaning of the Consumer Protection Act, 2019, including a Customer booking for a commercial purpose, any dispute shall first be referred to good faith discussions between the parties for a period of fifteen days and, if not resolved, shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The Company and the Customer shall mutually agree upon the arbitrator; failing such agreement, the arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Jaipur and the language of the arbitration shall be English. This Clause does not apply to a Consumer, and nothing in this Clause shall restrict any dispute-resolution remedy that cannot lawfully be excluded.
32. Changes to Terms & Conditions
TrailWithEase reserves the right to modify or update these Terms and Conditions from time to time to reflect changes in law, regulation, Services, technology, business practices, Supplier arrangements or other operational requirements.
Updated Terms shall be published on the Website with a revised effective date, and where applicable law requires prior notice of a material change, such notice shall be provided in the manner and within the period required by law.
The Terms applicable to a Confirmed Booking shall be those in force at the time the Booking was confirmed, subject to any subsequent changes required by law or expressly incorporated into the Booking by reference to applicable Supplier terms.
33. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to remain valid and enforceable.
34. Entire Agreement
These Terms, together with the applicable quotation, booking confirmation, itinerary, cancellation policy, Privacy Policy, Supplier terms and conditions, fare rules, service-specific terms and other terms expressly incorporated by reference, constitute the agreement between the Customer and TrailWithEase for the relevant travel services. In the event of any inconsistency, the terms of the applicable Booking-specific document shall prevail for the relevant Service component, followed by these Terms, except to the extent otherwise required by applicable law.
35. Acknowledgement
By making a booking, making a payment, or availing any service from TrailWithEase, the Customer confirms that they have read, understood, and accepted these Terms and Conditions and the applicable quotation, Booking confirmation, itinerary, cancellation terms, Supplier terms and Privacy Policy.
36. Accessibility
The Company endeavours to make the Website accessible to persons with disabilities in accordance with Section 42 of the Rights of Persons with Disabilities Act, 2016 and the standards notified thereunder. A person facing difficulty in accessing the Website or in completing a booking may contact the Grievance Officer, who shall render assistance through an alternative channel.
37. Notices
A notice under these Terms shall be in writing and shall be sent to the Customer at the email address furnished at the time of booking and to the Company at the email address in Clause 30. A notice sent by email shall be treated as received on the next working day.
38. Assignment, Waiver and Survival
The Customer may not assign these Terms or any rights or obligations arising under them. The Company may assign, transfer or novate these Terms to an affiliate, successor, purchaser of the relevant business or assets, or other entity as part of a merger, restructuring, financing, sale, transfer or reorganisation, upon notice where required by law. A failure or delay by the Company in enforcing a provision of these Terms shall not operate as a waiver of that provision.
Any provision which by its nature is intended to survive termination or completion of a Booking shall survive, including provisions relating to payment obligations, intellectual property, privacy, confidentiality, limitation of liability, indemnity, dispute resolution, governing law and accrued rights.
39. Limitation
Nothing in these Terms shall shorten the period of limitation prescribed by the Limitation Act, 1963 or by the Consumer Protection Act, 2019 for the bringing of a claim, and any stipulation to that effect shall be void under Section 28 of the Indian Contract Act, 1872.
40. Language
These Terms are published in English. Any translation is provided for convenience only, and in the event of an inconsistency the English version shall prevail.
